With the advent of the Convention it became unlawful for public authorities to do anything that is contrary to their human rights. This includes the UK Government and its immigration departments and officers. It also includes private companies that are paid by the state to run immigration detention centres and asylum interviews.
The contents and protection of the Convention apply to every person in the UK, and within the influence of the UK authorities. Most importantly it also includes anyone granted temporary permission to remain in the UK, whether or not they had permission to enter in the first place.
What this also means is that anyone subject to an immigration decision has the right to appeal to the European Court of Human Rights, separate to the appeal system that they have under the UK laws already in place. Cases that have already been through the UK courts show that it is not possible for the immigration department to deport anyone if this would not be in line with the obligations of the UK under the Convention.

The Basic Rights
Immigration, as stated above, is a result of many things, the worst of which could be torture, degradation and inhumane treatment as a result of governments and local politics or religion. Article 3 of the Convention, and the UK’s own Human Rights Act, specifically prohibits such behaviour; therefore it would be unlawful for the UK immigration service to return any immigrant to their own country if there is a strong chance that they will have to face it, irrespective of any crimes they may have committed in the UK.
In addition to protection from abhorrent treatment under Article 2, immigrants who are being detained while applying for permission to stay in the UK must be treated in a way which protects their personal security and freedom; this comes under the wording of Article 5 of the convention. It is often used when determining whether or not their detention is in fact legal.
In addition to the above, the convention also provides protection for the families of immigrants. This is under the heading of a right to respect for family life, and can include more than immediate family (grandparents, aunts or uncles etc). Article 8 of the Convention specifically states that where there is no safe alternative country and/or insurmountable obstacles to relocation, or if the immigrant cannot return to their own country safely, then the family must be granted immigrant status. This right is not absolute and it can be prevented if it is deemed legitimate, for instance if the family member is a known terrorist or would present some other threat to public or national security.
Essentially this means that the incumbent Government, or any opposing democratic party, must find a means of balancing all interests, general or political, in relation to immigration issues. Protests can be made to support any area of law governing illegal immigrants and immigrants rights, but all decisions must be made within the spirit of the Convention itself. My future husband has been imprisoned for 4 months and he had another 4 months to stay imprisoned, in total 8 months. The Immigration Office has offered him to leave the country, because of the circumstances and his mother being ill, he choosed to go home. I am an UK resident and soon I will give birth. I know that my baby has the right to become a British Citizen. Can I apply for his ban to be lifted, or do I have to wait till I become British Citizen? This will be next year. I need advice on what to do or expect.
I entered the UK illegally about 26yrs and applied for Asylum 24yrs ago which was refused after 6months consideration. After 14yrs of continuous living in UK, I applied for ILR and was later granted 30mnths in 2014.
I applied to renew before it expired in May 2017 using form DL, but my application was rejected in mid January 2018 as invalid.
By the end of January 2018, I reapplied using form FLR (FP) and got an acknowledgement letter mid February 2018.
I got a letter dated 10th March 2018, received on the 13th March 2018 that I have been granted bail exemption and that I should start signing at one of the Home Offices from Next week which should repeat forthnightly until deportation and contact voluntary leave help if I wish.
Does this mean I'm going to be deported and my open application is ignored or what ?
This application is just me ( I lost the children I had ).

I am a British citizen and currently staying with my husband who is not british (we legally married since Nov 2017) now expecting our first child together.
We made an application to regularise my husband's stay (as his last visa had expired in feb 2017) prior to us getting married and we made the application for leave to remain as a partner and under Article 8 rights. We are now hitting the 6 month mark since we made the application and still no response. We have been sending the UKBA updates i.e our marriage certificate and confirmation of our pregnancy in the hope it would assist our application but we have had no response.
My husband is not working at the moment and I am the sole breadwinner, we are anxious that the time frame and the lack of response will leave us in a difficult situation if he is unable to work when the baby comes.
Please would you advise how we can expedite the process? Is there any way that my husband can find work whilst we wait for the result?

I would like some advice please, I am a British citizen. I met my fiancé and after a few months realised I am three months pregnant. Two days before our wedding he was taken to an irc, I work part time and in the past have had depression I am starting to feel very low as he has been in detention for a month and his bail was refused with detention centre. I am a law abiding British Citizen (Aqcuired 2015 arrived here 2007) who have a permanent job and of good moral character. I had been continually supporting my son as much as I could in all aspect, emotionally, financially and spiritually.
My son’s custody was awarded to me from my nullified previous relationship with his father who have no involvement on his upbringing and had nothing to offer for my son’s future.
My eldest sister who is in Philippines looks after him for me and she rely all the decision on me and extend my love and support to my son. My sister who have a family of her own knows I am going to bring my son in the UK the soonest I filled all the requirements set out by the immigration on which I worked hard to achieve.
I might not have the chance to see him as frequently as I would love to, but that was the part of sacrifice I needed so I can be ready and be established before bringing him in UK. I have maintained good relationship with my son, I speak to him online regularly and I am the one to makes the final decision regarding his health, school and religion. I also decide on what he could buy or where he could go. I dedicated all my time with him whenever I go to Philippines. Even if I am here all I do is for him. I am not giving up on my son unlike other people who have failed and dismissed him.
The Entry Clearance Officer based the decision on Article 297 Immigration Rules, “Sole responsibilty”. The telephone interview with my sister had also had been interpreted differently. I consider the decision was even more biased on the second application refusal, after submitting all the pertinent supporting evidence it seems to me as if it was overlooked and disregarded completely I doubt that they even look at the legal representation from my solicitors which answered the reasons of refusal. Although I have relatives in Philippines, He is my child and among anyone else who should look after my son and who have the reasonable rights and resposibilities, it is me. I am the mother and I have been a single mother for my son because of the dismissal, irresponsibilites and neglect from other people who had been deemed better to look after my son according to Immigration Case Officer. I felt like I have been stripped off my rights to perform my legal duties as a parent which had been bestowed upon me by the Court decision in the Philippines. I have continually and earnestly trying my absolute best to give my son a better life. He did not deserve to be hurt over and over again.

I came to the Uk as an illegal immigrant from albania 3 years ago. I was 23 years old. My ex wife guided me and picked me up from Ireland and brought me to the Uk. Anyways my issue is something else. We ended up having 2 children together and i worked 7 days a week in a carwash (illegaly) for 2 years to support my children, handing all my money over to her and her mother (both with mental health issues). They took all my money, abused me physically and verbally, never allowed me to make any friends and then threw me out on the street. I was 17 years old when i have arrived in the uk as a student on 21st jan 2010. I extended my visa three times. Then in the middle of 2014 i went back home to visit my family when i got back I received a letter from home office “regarding English language test” you may know well. That letter indicated my visa has been cancelled which was about to expire in oct 2015 but before that I switched my visa to EEA as one of my relative from denmark had been living in the uk but my visa was refused. Couldn’t attach all the proofs. About the refusal my lawyer told me after a month that your application has been refused. Due to money problem i didn’t apply for any visa for 1 year. Then last year in December i applied same EEA visa And got refused in june2017 due to my EEA relatives ID wasn’t attached . For some reason my uncle wouldn’t give it to me. And also he is not in the uk anymore.

I live illegally in the UK since 2008, the thing is; my belief and culture have completely changed although I grow up Muslim for many years but really my vision towards Islam or any other religion became different, I'm afraid to go back to my country then I got prosecuted for what I've gained through my staying in a free country such as UK.
Besides, I've a large community of friends and families in here. Also a unique way of life which will be impossible to change by going back to the dark ages and the permanent restrictions in my country.
On the other hand, I can't even think of taking an action to get myself off of what I've done to myself unintentionally or with ignorance of law as a result of my own fears, which is the mean reason I can't make a decision or trust anybody even the solicitors, the majority of them are not honest, they only seek honey from a dead bee.

I want to bring my widowed mum from Asia to live with me permanently in UK, I am a resident here now. She is under 65 and her chances of getting any form of UK residency are almost zero. My only sibling is moving to UK too and I don't want my mum to stay in India alone. She gets epilepsy seizures time and again, if left untreated even for a short while, worst is inevitable.
Can I bring her on tourist visa and apply for residency under human rights stating:
- She is financially dependant on me
- She needs constant care due to epilepsy
- Her only sons are settled in UK
- We take charge for all her expenses and no public funds required for her. We will even take out private medical insurance for her so no access required to NHS.
- She will not be seeking any employment whatsoever.

I informed and asked cell subleader to change me from my stage( I work as assembly liner) 10 minutes before the end of the shift so I can go to the agency to find a solution of my problem without dealy the other person
11 minutes beofre shift's end I called him and he was standing and watch me,a cell leader from the next shift showed up to ask me if I need something because noone showed up to my calls
finaly he came the last 4 minutes and tell me that I can go only 5 minutes before.
Im doing a job of 2 stages that normaly requires 2 people there,I never complain,they never help me,they only showed up for 3-6 minutes and then go to other line's stages and help their friends for 20-30 minutes and plus that the last 1 hour that production is abouty to finish they send one person to show to the next shift's managment and team that im not running

Ireland, my mother applied for and received her indefinite
leave to remain in 2001. Again my mother assumed that the application
included myself and she was not unduly concerned. I myself was not
concerned either at the time as I arrived into Northern Ireland as a
minor and not in a position to apply for leave to remain. I attended
school locally and when I was 16 I received my National Insurance
number. By the time my mother had obtained indefinite leave to remain,
I was 18 years old and in further higher education.
After concluding my further education, I then went to work in a daycare
full time and then a care home for adults with learning disabilities. I
had my first child ( 2005) then 2nd child (2008) and 3rd ( 2011). I now work as a Senior Community care worker and have been since 2014.

illegally through a telephone call. This issue was highlighted as I was
told I needed to renew my own passport in order to get daughter a passport so she could travel to visit her fathers family in
London. However this was not the case and her father did obtain a
passport for her. I renewed my child passport anyway which I received
from my mother. Inside the passport it was stamped 6 months entry and
working was prohibited. I sent my passport away and received it back
with information on visas. Obviously i wanted this issue resolved as
soon as for it all came to a shock. I have lived here for almost two
thirds of my life and for all of my adult life. If I had known at any
time that I did not have leave to remain in Northern Ireland then I
would have acted immediately to rectify the situation.
Immediately I contacted my solicitor who after a couple years told me

I came in the UK earlier 2014 and claimed asylum on my arrival at the port. After period of time l had got my first refusal from home office and all my appeals had been dismissed. And l became appeal right exhausted. One and half year later,
i made what they called further submissions to liverpool with the evidence that nowhere to go back as i am still in risk in my country of orgin. But that did not change their previous decision.

I'm on a spouse visa for 3 years and and still have 2 yrs left for ILR. My husband who is British has suddenly decided that he doesn't love me anymore. Not only is this a shock because I thought we were happy and still love him but now I'm worried about the implications for me if we get separated or divorced. The UK has been my home for the last 3 years, I have a good job, a nice flat and now I lose all that along with all the emotional hurt and pain. He is the reason I came to this country. We have been together for 9 years, married for 4years and his life is fine because he is from here but what happens to me. Is it fair that I have to go back to my country leaving everything I've built here to start my life all over from scratch. Yes, that is my country but my life is here, work , friends, my flat.
What are my options if any?

I put myself through university without using public funds and I did not claim any benefits during that time. I paid my taxes like other people. I stopped working in 2009 and tried to return home but this was difficult without proper travel documents. I made another appeal and was granted an indefinite leave to remain in 2009. In 2013 I traveled to my home country on a Travel Document issued by my Embassy, I was going to apply for a new passport. When I got to my home country, I had a very bad reception and the officers refused to give me a new passport, I returned without a passport and encountered a few problems because of my traveling with a TD. I came back and last year I applied for a British Citizen hoping I would get a British passport.
I have been denied the British Citizen because I worked between 2003 and 2009 without permit. Currently I do not have a passport and I am finding it difficult to travel outside the country without a passport. I have been told that traveling to my country on a TD is risky as I might not be allowed back into this country. I am now in limbo I don't know what to do.
Please advise.
I am currently on a 5 year parental route to settlement. I was issued with a 2 and a half parental leave to remain visa in 2013 which will expire in 18/06/16.
Before the Conservative came into power, one is issued with the 5 year parental route visa and entitled to help from from local authorities to support your family if struggling. The current government scrapped that-no recourse to public funds even if you are looking/raising a child who is a British citizen. Additionally, you would have 30 months initial visa followed by another 30 months with each application fees. My first 30 months was £550 currently up to £811 and an additional £500 NHS surcharge introduced last year April.
I believe this surcharge introduced is unfair especially for applicants already on such visas residing in the UK for many years to be retrospectively included too.
As mentioned earlier, I have been here over 10 years, have a National Insurance card contributing towards the Health Service over the years through my NI contributions. I pay more than £500 a year to the NHS having to pay another NHS surcharge before my visa gets renewed is so wrong/extortionate.
I have no issue with the surcharge applied to first time applicants coming to the UK as they have not contributed anything towards the NHS. In my case I have done that for years, already struggling as a single parent, working hard to provide for my daughter/better life for her without the necessary help/support all because I am not yet a citizen yet though my daughter

My husband came to the UK in 2002 and we married in 2005 he has been granted discretionary leave on 2 occasions - we are now renewing but home office has claimed his application invalid due to his passport being expired and have now kept the passport. I have been in the UK for a year for a master degree. Now that i have gotten my master degree, i want to find a job in the UK. But haven't been successful. Most likely it is because my visa is a Tier 4 which soon expires. Other than marrying somebody with a British national, is there another way for a migrant like me to be able to stay in the UK and work legitimately? I think i should qualify as a high skilled migrant considering I have quite a work experience, and that I graduated from a UK's reputable university that is listed in the Home Office. If i want to switch to Tier 2 from Tier 4, should I already have a job offer from one of the listed sponsors? Because it's like a vicious circle where the company wants you to already have a working permit while it is impossible for a migrant to have a working permit without a sponsor. Is this a way of telling us that UK's job market is not open for us non EEA migrants despite our qualifications?

I was born in UK but taken back to Nigeria as a child. As my parents had a tumultous marriage - (major reason I understand they moved back to Nigeria), I was married off as a child to a comparatively elderly relative who subjected me to emotional, physical and sexual abuse. But at the time, my primary family unit had already broken and I really had no choose in what happened to me since this man offered my father that he would take care of me. Three years ago, I came to the UK for a masters programme and never returned to Nigeria because I do not want to go back to the family I left behind. Inherently, I am now an overstayer and quite confused on what to do.
I must say that I have seen a couple of solicitors but I am always too embarassed to open up about my issues, or I feel a sense of disconnect during the consultations that I just give up.
Any pointers in the right direction I should be taking will be helpful.

Here goes, so I married my wife from ghana she got a 2 yrs probationary visa and joined me in the uk in August 2010, upon completion of her visa in July 2012 we applied for a 2 year extension instead of the indefinite leave because during the probationary period we seperated and did not leave together for nearly 9 moths. Anyway the UKBA refused the extension in jan 2014, 1 1/2 years after we submitted the application. We appealed and and the judge allowed our application in August 2014, the Homeoffice did not appeal and they granted my wife a visa for 2 years valid till 2016.
Can we apply for ILR right away on the basis the 2years we had originally applied for in July 2012 has since lapsed and that we have since proved in court that our marriage is genuine? Please advise my wife is pregnant and would like this visa issue to stop stressing here. Thank you in advance

Currently I am visiting them under family visitor visa and was thinking to resign from my job as my wife is depressed and can not take care of our child alone.
