Anyone convicted of a crime in the UK, or being held on remand pending trial, will not be able to avail themselves of the full extent of the rights currently on the law books, or protected by the European Court of Human Rights. However, this does not mean that they become sub-human or less deserving of respect and dignity than anyone else, it just means that they are subject to certain restrictions.
If you believe your rights have been violated while serving your sentence, you can describe what happened using our free Rights Situation Checker.
Allocation
Upon arrival in prison you will be searched for any items that are not permitted in the prison, such as weapons or drugs etc. Any cash that you are holding will be confiscated and placed into a special account for your use. This may all seem a bit harsh but you need to bear in mind that the prison system is not designed to be a holiday-camp, recent headlines notwithstanding.
Each prisoner is required, as part of their time in Prison, to abide by the rules laid down by the Prison Act 1952 and also to any rules or regulations that cover that particular establishment.
Once you have been searched and assessed you will be allocated a certain category based, in part, on your offence and on your behaviour. The basic regime has the strictest rules and fewer privileges than its more favourable counterparts (the standard or enhanced). Also, again dependant on your particular offence, you may be immediately segregated from the rest of the prison population. Many critics of the prison system would say that this is not necessary; that all prisoners should be together and whatever happens; happens. This would be a breach of one of the most fundamental human rights; protection of the body and respect for dignity.

Describe what has happened and find out which UK human rights protections apply and what you can do.

It is a breach of the Prison Act to deny a prisoner the ability to contact his family and loved ones. Therefore card or PIN telephones are available in all prisons however, for security purposes, all calls are taped except those to legal counsel, the Samaritans or other similar organisations. In some cases, as a punishment, the Governor may restrict phone use although this is in breach of the European Convention on Human Rights.
In addition to phone rights the Prisoners also have the right to send two letters to loved ones; one ‘statutory’ letter and one ‘privilege’ letter. The privilege letter can be stopped as a punishment but the statutory one cannot. All letters coming from inmates of High-security prisons and Category A offenders will be read and possibly censored. This also covers letters to legal counsel, although this is just intended as a measure to ensure that it is actually legal in nature and not a ploy intended to assist the inmate in breaking the rules or committing further offences.
In addition the Governor of the prison, no matter which category, has the power to send back letters sent to inmates if they are too long or if there are too many arriving. This may be a breach of personal freedom but this must be offset with the need to keep order in the prison system.

Restrictions
Make no mistake, no matter what your crime, you will be subject to the Prison Rules while you are a ‘guest of the state’, however many of your basic rights are unchanged. You still have the right to food, protection from assault and access to the courts. What you lose are your civil right to vote and your right to personal freedom, among others.
What we have at the present are basic needs being met in the form of food, housing, work, education, protection and acknowledgement of the family unit. The law is still developing in this area and it may be that further rights are introduced as the law changes; it may also be that rights are removed by necessity or for security reasons. Whether the Rules past, present and future can stand up to the scrutiny of the European Court of Human Rights is a matter for the Prisoners groups and the Lawmakers but the prison system is its own society and therefore any proposals for change in this area will be the subject of intense debate.
My husband is also locked up for 24 hours a day. He hasn’t seen his children in 6 months.
How can the prison system keep them in isolation for so long? When will they listen? When enough people start harming themselves?
My son put in a Comp 1 and Comp 2 but has had no response other than his CM saying the prison knows it’s a very bad mistake to make and a report has been written. He was asked if he wanted to change prisons, my son said no, he’s ‘settled’ if you ever can be and knows who and who not to talk to.
What’s his next step? Where does his next complaint go to and what is the best he can expect?
. They are on 24 hour bang up due to coivid have meals brought to cell, no exercise and little to no health care checks. Hes had no family visits for 14 months now and get no idea of what is going on re his status.
I understand completely that there are exceptional circumstances but surely if this is the way things are going to be for the foreseeable future then every day life has to be reassessed and adjusted for all concerned?
It is now 11pm my son has not received any ointments or antibiotics.
His wounds started to burst and pus oozes out of them,it itches terribly!.Nobody responds to his requests. How can I help him. My heart breaks.
Most people would have been up in A&E by this point. My friend has geared herself up to never seeing her son again or even possibly donating a kidney to him at Christmas. Nobody deserves to be left untreated health wise. If anybody has ever heard of anxiety being the cause of blood in the stools or urine then please show me the evidence!!!
We were told to write and send a postal order with his full name and all other details of his and it should get to him. We sent all this a week ago still waiting to hear. Is this normal?? as this is completely new for me.
Is there any reply?
He wants to push for he's cat d but doesn't want it to get rejected what should he do? He has completed he's sentence plan and has never been in trouble.
My partner has been in prison for 2 years, he was granted his Cat D but due to on going issues with a POCA & a complaint about the OMU Governor at HMP Wandsworth, this has been revoked. Is there any advice you can offer please, as we cannot afford a lawyer?
Zed
Thanks
Many thanks
Reply from judge : something to do with a court in May. I said " i wasnt in court in may what are you talking about...?
Resaponse by judge : your unapologetic i sentece you to 28 days in prison remove the prisoner ..
(still with no explanation why i was there.)
i was then bundled into a prson bus and spent 14 days locked up in m wing at derby prison
released still with no explanation...
when i eventually got home my 4x4 was gone and the locks changed on my house without my consent i then phoned the police who then arrested me for breach of non mol,, order at my own house where i lived ..
the above is all factual and true not made any of it up...
any thoughts oh tried my mp at a cost to me over over £1000.00 having to travel and see him jeramy lefroy (of stafford) said thats a breach of your civil liberties and did nothing.!
Any thoughts...
I'm told because of charge he isn't allowed a pin for the phone so have had no contact... worried sick. Is this not breach of human rights? Also using email a prisoner I have send many and had no response after 4 days... is this right? I'm so worried and confused never been in this situation before! Any advice would be appreciated
I have a few questions if anyone knows the answer to them or advise me on it.
1. How soon can he call or write to me.
2.how can I locate what prison he's in.
3. How soon will I be able to visit him.
Thanks
Lizzie
You can only ever get a tag if you are serving under 4 years as a sentence. Perhaps 3 months before release date. If the original sentence was more than 4 years he will not be released on tag.
He was arrested then kept in custody and charged with gbh and criminal damage. against myself was refused bail, and then sent to prison on remand. I had on the Saturday withdrew my statement from police before all of this because I wanted to get him the help he needed. He has the option tomorrow to apply for bail but not sure If he would get it. But then crown court isn't until 8th August. Am I allowed to contact him? Or visit?
Could someone please help me.
My partner was taken on remand to a prison pending trial in June .
I’m trying to exhaust every avenue to help his case with character references etc .
Is there anything else that I can do from the outside to help his case and bring him home to me.
He made a silly mistake and is now paying for it .
Like everyone else I can easily say he isn’t a bad lad and never in trouble but that’s a perfect life .
We are all human we all make mistakes and learn from them .
Any help will be greatfully appreciated .
But the prison they are moving him to , his life will be at threat .
I'm so worried for him .
Is there anything he can do to stop this move to this prison .
He's been in jail for 4 weeks when will he be sent to an open prison
I want to send a letter to my partner at thameside. He wont know my number as its kind of new and i have no stable address he can write to.
If i send a letter without the prison number.just his full name.will he recieve it.
I need to also send money. The prison have not picked up the phone all day.
Thank you
This cannot be legal
My brother is in Manchester Prison. for the last FOUR weeks they have not had hot water. Seems no one really cares about the prisoner's, becaue they are prisoner's. This is buse and neglect in its lowest form.
Despite their current residence, they DO have rights. Why has this been allowed to continue for so long. You have had numerous people write on here bringing up the extended issue of NO hot water in the prison. Interestingly in 2 seperate prisons. What is going on? I don't believe for 1 second that the water happened to go out at the same time in 2 different prisons. What is this? An attempt to save money at the expense of the prisoner's personl hygiene? Something is not right with this situation.
You have a prison full of guys and NO hot water. This is inhumane and unusual punishment. I can't believe for one second that there is any good reason, other than lack of care and concern for the prisoners, why this has been allowed ot continue for 4 weeks or more. Writing to the governor proves to be fruitless, and never any response, they simply lie nd pretend they had no knowledge. We constantly hear negative reports of prisoners, yet, no one want's to acknowledge the HUGE pink elephant in the room. THE PRISON SYSTEM IS BROKE...LITERALLY.
Absent any shame, which I think is relied upon, in order to keep prisoners quiet, this needs to be made public. Ther is absolutely NO excuse why this has continued for more than 30 days..... Ridiculous! Im sure the governor9s) respond to the outcry. Prisoner's have family that love them, and the fact that they are prisoner's do not change that Fact. The shame is on England and its terrible inhumane conditions. Maybe it is time to put the spotlight on what is relly going on inside these delapidated walls.
I am going to the media, perhaps then it will be taken seriously and all those working in this less than stellar judicial system will be reminded of something frequently forgotten. Prisoner's have Rights, Rights, that are consistently denied, ignored and mocked.
I have relative who is currently over 500 miles away from home and hasn't had a visit in over 20 years. Each time someone comes to visit he is unable to be seen for some reason or another. The family travels from Wisconsin to Florida to visit him and we are not allowed. We were told by our state representative that he shouldn't be that far away from home and we have petitioned three times to have him brought closer to home but the warden keeps denying him. He was diagnosed with prostate cancer and has over three hernia surgeries he has been locked up for over 26 years and the past 20 years we have not been able to see him for one reason or another. We sent in tons of letters of concerns. He is in Coleman Medium and he shouldn't be there. He currently has no health issues. The doctor that botched up his prostate surgery in California followed him down to Florida is trying to force him to do another surgery and he is scared to death. Can someone please help?
He suffers from multiple problems and is under specialists in the community which he has provided proof, the prison have cancelled some of his hospital appointments and failed to take him to a two week cancer referral appointment. Is this against his human rights?
In prison, if the prison are full.. you want them out In society but you don’t give them a chance .also Is there anyways we can request my nephew come home for a visit on New Years? Or even spent the day with us outside the prison
It beggars belief!! My friend could have stayed on Methadone throughout his one year sentence, but was determined to turn his life around. I had told him at the start it was very brave, as it's not like being on the outside, the help may not be as reliable, or readily available. But he was determined to get back healthy and well, to his 3 children who were living with his brother. He has a 5 day a week job, where he works all day, he has kept this up throughout his detox, he's no trouble and has been used by the staff as a Listener....but no one is listening to him!!! He is a good man, with a good heart, which is why my husband and me are so desperate to help him. We are very worried about his mental and physical well being. He really doesn't want to start using again, especially in prison, but is desperate now, and ridiculous as it is, of he starts using again, at least they will put him back through the system again! Is there anything he can do please, so that he can at least go to pick up his meds and find them actually there, whilst he has to wait the insane period of six weeks to be seen again please? Any help would be gratefully received. They have implemented a non smoking ban, with his wing as the trial wing too, so he is at his wits end! Only 2 meals a day, child size portions....I know prison isn't supposed to be a holiday camp but they are supposed to look after them. Lock a man up for a year, you're responsible for his diet, and healthcare in the least!! I'd like to add, my friend hasn't moaned once in all these weeks.
Thank you
He's got 8 weeks but my boyfriend rung me yesterday and said he got told when he arrived to the prison he will be doing 4 weeks in and 4 weeks out on licence?
Will he be doing half his time so 4 weeks? As I've always been told everyone does half their Time? So confused and i just have so many questions to ask him when he rings but not enough time on the phone...
How many phone calls does he get and what times can he call?
He said he can't put no credit on till Monday now?
Sophie
Can they write to each other in jail or not? Iv been told there writing to each other but surly they arnt aloud due to both getting charged with the murder
My brother is currently serving a 5 year sentence in prison however his health has seriously deteriorated since his conviction. A doctor has told him that he has a very low body fat, he's beginning to faint, feeling nauseous and weak etc. Although the treatment for this is a specialised diet with high fat and calorie content he has received no support in this manner whatsoever and is continuing to deteriorate. Doctors have warned that this is very dangerous to his health, its is affecting his heart and if its not treated quickly will cause a heart attack. Is this neglect? I am unsure how to proceed as he is feeling very ill but nothing is being done to help. Surely this is against his human rights?
Kind regards.
Contact action for prisoners families immediately
Until now ( its been 2 weeks) we dont know what prison she is in... how long she been gone for etc... not even her familly know.
She is one of our best staff and are awaiting her return.

My partner is in jail, has been for two years. He got ten years but is doing 5.( drugs related)
He has a son but the mother is not bringing him in to see him. My partners relatives were bringing him for her but can no longer do this.
What rights does he have in regards to getting her to bring the son to see him? Is there anything he can do? She is currently ignoring all correspondance from my partner.
Thanks
That was 2 weeks ago now and still no letter . I've got pre eclampsia now and I'm in hospital with it unable to stop worrying . I can't think of any reason he wouldn't write as we are best mates as well as partners . I know My Man better than he knows him self ,and I know he'd never leave me worrying like this with no contact with my family he was beside himself leaving me . What could be the reason for this I've rang Woodhill and they said there is a long waiting reply for locating and requesting my concerns to him. I don't know Wat to do
I have written to Judges, Mps, Government, The officers in Elmley are acting like little Hilter's. I have done my best to improve things I think the time is now right to have things published .The letters I get from my son are begging me for food this can't be right starving someone in this day and age. I my was on house block one and forgotten about for 3 month's. i do know the man responsible for this and legal action will be taken.
On son lost a third of his body weight in 3 months because he wasn't being fed.
My son also sufferers from a medical problem he bleeds from his rectom , we are still waiting for medical treatment. I have contacted Mps An.drew Selous Julian Braizer even Micheal Gove himself. I have so many very interesting emails and letters I am thinking about going pubic and telling tax payers what going on in prisons that we have kept hidden from us.
he is on a drug rehab programme and also has HIV
I don't believe him as he tells so many lies
Surely he would have access to these things ?
he has been there long enough for it to have been arranged
He has made several complaints that the prision is slow and understaffed and has limited contact with his OMU due to staffing. He is a cat c prisoner in a cat a prison. His tag eligibility date was 3 days ago..
Would the court allow me to have that information - I do have Power of Attorney?
There is an officer in there who told my partner as far as he was concerned he had done nothing wrong hes being bullied by the officers n govener i have statements off lads in there saying my partner is being targeted but hes done everything right he was so close to sitting parole doing well with everything so this has come as a massive shock ime going to my local mp as i cant get no answers from his probation officer he rang me at teatime from wheelston without a clue wat had happend they didnt let him take his property he was a broken man ime so scared what the system is doing to him ime thinking about contacting the local news we dont know were to turn
Just because the govener has a problem this is wrong on so many levels
Av you any ideas what a can do to fight the system
Thanku
He has been a good prisoner and done everything that has been asked of him and has been a 'Listener' has helped to teach other prisoners to read etc.
My question is: does he need a Human Rights Lawyer to move this forward.
Someone who used to live with me has been sent to prison is it possible to find out why they are there
I just wanted to know if the time in custody and HDC would be counted towards his 27 months sentance? He received his release notification and it hasnt been counted for some reason. He tried to contact his personal officer but no one is willing to do anything and his solictor is not intreasted in the matter as he said the case is now closed.
can i as a family member contact behalf of him to find out if his sentance has been counted right? He's been moved to different prison far from home too without any reason.
I would really appropriate if you Could kindly advice on what can be done in this case. I will look forward to a reply. Thank you
He has been an enhanced prisoner for the whole of his sentence and has placed himself on the protection wing (Feb)
He has requested a side move to another catB prison but so far he is still there. He won't allow us to visit as he is concerned someone may follow us home.
They are giving no reason for the delay in transfer.
does he go to cat d first before his release or does he
just get released on this date.
Im really worried about my son being able to see his baby girl.
He was imprisoned on october and his daughter was born in November. Myself, his Dad and his fiance have visited and we had been told we can go for a family visit in April but since then he has told us that he has been told he may not be able to see his daughter now!
He is serving 1 year for sex with a minor this all happened 2 years ago, before he got a good job,met his fiance and they where in the process of setting up home together!
He was (at the time) a very immiture 21 and the girl was 14.
She had had a relationship before this with a 19 year old.The relationship was consentual (although by law not recognised as such due to her age!)
My son ended the relationship after pressure to do so and realisation that it was wrong.
Her father brought it to the attention of the police at first reporting it as rape. Once texts between them revealed no such thing as a relationship was reported he under uk law had to be prosecuted.
Both myself and his fiance, although realise
Britsh law on this matter feel it is wrong and very one sided.
He needs to see his daughter and be able to bond with her!He gets so upset when he talks about her and its just not right under his human rights surely!
Please can someone advise us on how we can address this as soon as possible
Thanks
Can he claim compensation?
December 2012 there has been confusion over how much time he has to spend in prison out of the 10 year sentence
Sent from my iPhone
I'm at a lost of what to do ?
My partner is nearing the end of his sentence 9years and doing 4years with only 7months left he has just been moved from wymott to Risley ? He has put forms in for cat d and nothing back since October last year he was moved to Risley for resettlement and is now locked up 22hrs a day ?? How is this resettlement ?? He's asked for a comp one form and is still waiting
What can I do or he do ? Or is he to wait until he's released back into society with no integration ? Probation can't help said its nothing to do with them it's down to the prison ? I would be grateful for any advice
Thank you in advance
I feel I need to see him face to face to get answers as I haven't had any contact with him since the day he was arrested
How do I go about this
His probation officer had informed us that she is not required to write any supporting report for the cat application meeting as he is considered to be low risk. so the decision will be made solely in the prison.
We also understand that he will now need to start the six weeks course again, but he can also do this as a cat D prisoner. Will not completing the four days of the course affect this cat D application, even though it was not his fault that he had to be moved. He had requested that the hearing be held in his absence but this was refused.
If it affects his cat D application, can we get a lawyer to challenge this decision please.
My husbond been in jail for the saling dtolken phones. i dont know the astimated price of it.
and dont know from which court he was sent there.
He contacted his friend, and just said that he is in jail, but for how long doesnt know.
how is it possible?
And in general, for how long the person can be in prisoned for that crime?
I live out the Uk. Who can help with our situation?
Who i contact to?
I dont know, when next time he will contact somebody, so wanna get it clear.
What can help to make the term shotter. he is the father of two y o son.
Is there anyway we can help by getting him changed to a catergory C prison, hes non violent and has never been in any trouble before.
He is 64yrs and my mum is 74yrs and not of good health so the travelling over from Devon is really hard?
He was working in his previous prison, had an excellent behaviour report and had been given enhanced status and responsibility. He is currently back to being locked up 22 hours a day.
Is it normal for this to happen and for any communication to take so long?
Last week he won his appeal and his conviction was quashed, the cps are going for a retrial but this has not yet been confirmed.
My nephew is still being held at hmp whitemoor but there have been no new charges brought against him and its 5 days since it was quashed at royal court of appeal.
Any advice would be appreciated
A prisoner on remand (waiting for their trial) is allowed three 1-hour visits a week. A convicted prisoner is allowed at least two 1-hour visits every 4 weeks.
day and age i no my son should not of got him self in to trouble to end up in a
prison but he as always been an enhanced prisoner for the 3 years he has been in a prison but they have now maid him a basic prisoner as they say he had a phone in his cell he would not of been that daft as he just put in for a cat d prison due to me being so ill after brain surgery last year how they can do this with no phone for prof is beyond me he was doing so well and teaching other prisoners to read write and things so to my way of thinking they do not have a lot of common sense in these places
